Terms of service
OVERVIEW
Welcome to TweenLeaf.
The terms “we”, “us” and “our” refer to TweenLeaf. TweenLeaf operates this online store and website, including its related information, content, features, tools, products and services, to provide customers with a curated shopping experience (the “Services”).
TweenLeaf is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. By visiting, interacting with or using the Services, you agree to these Terms of Service and our Privacy Policy:
https://shop.tweenleaf.com/policies/privacy-policy
If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable German or European Union law.
SECTION 1 - ACCESS AND ACCOUNTS
You must have the legal capacity required under the law applicable to you to enter into a binding contract. If you are under the applicable age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.
To browse the store, place an order or use certain Services, you may be asked to provide information such as your name, email address, billing information, payment information and delivery address.
You agree that the information you provide will be accurate, current and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please notify us promptly if you believe that your account has been accessed without authorization.
You may not transfer, sell, assign or license your account to another person without our prior written consent.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display our products accurately. However, colors and other aspects of a product may appear differently depending on your device, screen, lighting and display settings.
Product mockups and lifestyle images may be used to demonstrate how a product is expected to appear. Minor differences may occur between an online image and the delivered product because of garment characteristics, manufacturing tolerances and the printing process.
These statements do not affect your statutory rights where a product is defective, damaged, incorrectly supplied or materially different from its description.
Product descriptions, availability and specifications may be updated where reasonably necessary. We may discontinue products or restrict available quantities, provided that this does not affect orders we have already accepted.
Products are generally produced or printed after an order is placed. Any customization or personalization options will be identified on the relevant product page.
SECTION 3 - ORDERS
Placing an order constitutes an offer to purchase the selected products.
After you place an order, we may send an acknowledgement confirming that we received it. This acknowledgement does not necessarily mean that the order has been accepted.
A binding purchase contract is formed when we expressly accept the order or send confirmation that the order has entered production or has been dispatched, depending on the information provided during checkout.
Payment authorization and processing may be required before an order is accepted.
Please review your product, size, color, delivery address and other order information carefully before submitting the order.
If you notice an error after placing an order, contact us immediately at support@tweenleaf.com. Because products may enter production shortly after an order is accepted, it may not always be operationally possible to change or cancel an order. This does not limit any mandatory cancellation or withdrawal rights provided by law.
We may refuse or cancel an order where reasonably necessary, including where:
- the product is unavailable;
- payment cannot be authorized;
- the delivery information appears invalid or incomplete;
- an obvious pricing or description error has occurred;
- fraud or misuse is reasonably suspected; or
- accepting the order would violate applicable law.
If we cancel an order after receiving payment, the relevant payment will be refunded.
Returns, refunds and statutory withdrawal rights are described in our Refund Policy:
https://shop.tweenleaf.com/policies/refund-policy
SECTION 4 - PRICES, TAXES AND PAYMENT
The price charged will be the price displayed during checkout when the order is placed, subject to correction of obvious errors.
Prices, discounts and promotions may change before an order is placed. Changes will not affect an order that has already been accepted unless required by law or agreed with the customer.
Applicable taxes will be displayed or included as required by law. Delivery charges and other applicable costs will be shown before the customer submits the order.
For deliveries outside the territory in which applicable taxes or duties were collected at checkout, the recipient may be responsible for import duties, customs charges or local taxes where clearly disclosed and legally permitted.
You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the payment method supplied with the order.
Payments may be processed by Shopify Payments or another third-party payment provider. Those providers may process payment information in accordance with their own terms and privacy notices.
SECTION 5 - SHIPPING AND DELIVERY
Available delivery destinations, delivery charges and estimated delivery times are shown during checkout or in our Shipping Policy:
https://shop.tweenleaf.com/policies/shipping-policy
Delivery times are estimates unless we expressly agree to a guaranteed delivery date. Production time and shipping time may vary depending on the product, delivery location, carrier and order volume.
We will provide available tracking information after dispatch where supported by the carrier.
We are not responsible for delays caused exclusively by events outside our reasonable control. However, this does not remove any statutory rights you may have if an order is not delivered within an agreed or legally required period.
For consumer orders, we remain responsible for loss of or damage to the products until they are physically received by you or by a third party designated by you.
An exception may apply if you independently commission a carrier that was not offered by us, as permitted by applicable law.
Please contact support@tweenleaf.com promptly if an order does not arrive, arrives damaged or appears to have been lost in transit.
SECTION 6 - INTELLECTUAL PROPERTY
The Services and their contents—including the TweenLeaf name, logos, brand elements, text, graphics, images, videos, designs and arrangement—may be owned by TweenLeaf or used under license and may be protected by trademark, copyright and other intellectual property laws.
You may use the Services for lawful personal and non-commercial purposes.
Unless permitted by law or expressly authorized by us, you may not reproduce, distribute, modify, publicly display, republish, sell, license or commercially exploit protected content from the Services.
No provision in these Terms transfers ownership of intellectual property belonging to TweenLeaf, Shopify or any third party.
“TweenLeaf,” associated logos, product names, designs and slogans may not be used in a manner that suggests endorsement, affiliation or ownership without prior permission.
Shopify’s names, logos and related marks belong to Shopify or its licensors. Other names and marks displayed through the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
We may provide access to tools or services supplied by third parties.
Third-party tools may have their own terms, privacy policies and technical requirements. Please review those terms before using the relevant tool.
We do not control third-party tools and are not responsible for their independent operation, availability or content except to the extent that responsibility cannot legally be excluded.
Your use of an optional third-party tool is voluntary and at your discretion.
Future features, tools and resources that form part of the Services may also be subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites, platforms or resources operated by third parties.
A link does not necessarily mean that we endorse or control the third-party website or its content.
If you access a third-party service, its own terms and privacy policy may apply. You should review those terms before making a purchase or providing personal information.
We are not responsible for independent transactions made directly with a third party, except where applicable law provides otherwise.
Questions or complaints concerning products or services purchased directly from a third party should normally be directed to that third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
TweenLeaf is powered by Shopify, which enables us to provide the Services.
However, purchases made through our store are made directly from TweenLeaf. TweenLeaf is the seller responsible for the sale, subject to applicable law.
Shopify is not the seller of TweenLeaf products and is not responsible for fulfilling orders or handling TweenLeaf customer-service obligations.
Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 10 - PRIVACY
Personal information collected through the Services is processed in accordance with our Privacy Policy:
https://shop.tweenleaf.com/policies/privacy-policy
Because Shopify hosts our store, Shopify processes certain personal information to provide, secure and improve the ecommerce platform.
Information may also be processed by payment providers, fulfillment providers, carriers and other service providers where necessary to operate the store and complete orders.
Some providers may process information in countries outside your country of residence. Applicable safeguards and further information are described in our Privacy Policy.
Shopify’s privacy information can be reviewed through Shopify’s official website.
SECTION 11 - FEEDBACK AND REVIEWS
If you voluntarily submit a review, suggestion, photograph, comment or other feedback, you confirm that you have the right to submit it.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display that feedback for operating, improving and promoting TweenLeaf and its products. This license does not transfer ownership of your content to us.
Where legally required, we will request additional permission before using identifiable customer photographs or personal information in advertising.
You must not submit content that:
- violates another person’s rights;
- is knowingly false or misleading;
- is unlawful, threatening or abusive;
- contains malicious software; or
- falsely represents your identity or relationship with another person.
We may moderate or remove content where reasonably necessary to comply with law, protect other users or maintain the integrity of the Services.
SECTION 12 - ERRORS AND INACCURACIES
Occasionally, the Services may contain typographical mistakes, outdated information or errors involving product descriptions, prices, promotions, availability, shipping charges or delivery estimates.
We may correct such errors and update information.
If an obvious error affects an order you have placed, we will contact you where reasonably possible and give you an appropriate opportunity to confirm or cancel the affected order.
Nothing in this section limits mandatory consumer rights or permits us to alter an accepted contract unilaterally where doing so would be prohibited by law.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services to:
- violate applicable laws or regulations;
- infringe intellectual property, privacy or other legal rights;
- transmit malicious software;
- engage in fraud or impersonation;
- harass, threaten or abuse another person;
- provide intentionally false or misleading information;
- send unauthorized spam or similar communications;
- interfere with the security or operation of the Services;
- bypass access controls or technical protections;
- scrape or extract data in violation of applicable law or our rights; or
- use the Services in a way that materially harms TweenLeaf, Shopify, customers or other users.
We may restrict or terminate access where reasonably necessary because of a material violation of these Terms, fraud, security risks or legal requirements.
SECTION 14 - AUTOMATED SYSTEMS AND AGENTS
Automated systems, bots and AI agents must not access or interact with the Services in a way that violates applicable law, bypasses technical safeguards, disrupts the Services or misrepresents automated activity as human activity.
Automated systems must respect applicable access restrictions, security controls and published technical instructions.
We may limit automated access where reasonably necessary to protect customers, store security or service availability.
This section does not prohibit lawful use of accessibility technology, ordinary search engines or tools expressly supported by the Services.
SECTION 15 - SUSPENSION AND TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access to an account where reasonably necessary because of fraud, unlawful activity, security risks or a material breach of these Terms.
Where appropriate and legally required, we will provide notice and a reasonable opportunity to remedy a violation.
Termination does not affect rights or obligations that arose before termination, including payment obligations, accepted orders and statutory consumer rights.
Provisions that by their nature should survive termination—including intellectual property, liability and governing-law provisions—will remain effective.
SECTION 16 - WARRANTIES AND STATUTORY GUARANTEES
We aim to keep the Services reasonably available and accurate. However, uninterrupted or completely error-free operation cannot be guaranteed.
Nothing in these Terms excludes or limits any statutory warranty, guarantee or remedy that applies to a consumer.
Products must conform to the contract and their description and must possess the quality and characteristics consumers may reasonably expect under applicable law.
Consumers may have statutory rights to repair, replacement, price reduction, contract termination or reimbursement where products are defective, damaged or non-conforming.
For consumers in the European Union, a minimum two-year statutory legal guarantee generally applies to new goods, subject to applicable national law.
Any commercial guarantee offered by a manufacturer or another party is additional to, and does not replace, your statutory rights.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability:
- for death or personal injury caused by negligence;
- for fraud or fraudulent misrepresentation;
- for intent or gross negligence;
- under mandatory product-liability law;
- for breach of mandatory consumer rights; or
- where liability cannot otherwise legally be excluded or limited.
Where legally permitted, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer’s non-commercial purchase.
For ordinary negligence, liability may be limited to the breach of material contractual obligations and to damage that was reasonably foreseeable, to the extent permitted by German law.
Nothing in these Terms affects mandatory statutory rights, including rights relating to defective, damaged, incorrectly supplied or non-conforming goods.
SECTION 18 - RESPONSIBILITY FOR MISUSE
You are responsible for losses reasonably resulting from your unlawful use of the Services or your material breach of these Terms, to the extent provided by applicable law.
Any obligation to compensate us will be limited by applicable law and will not apply where you are not responsible for the relevant breach.
Nothing in this section creates an obligation for a consumer to compensate us for exercising a statutory right.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the extent legally permitted.
The remaining provisions will continue to apply unless the invalid provision is so essential that the agreement cannot reasonably continue without it.
Any mandatory legal provision will apply in place of an invalid provision where required by law.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
A failure or delay in exercising a legal or contractual right does not automatically constitute a waiver of that right.
These Terms and the policies expressly incorporated into them form the agreement governing your use of the Services.
Mandatory information, product descriptions, order confirmations and individually agreed terms may also form part of a purchase contract.
If an individually agreed term conflicts with these general Terms, the individually agreed term takes priority to the extent required by law.
Ambiguities will be interpreted in accordance with applicable law, including consumer-protection rules.
SECTION 21 - ASSIGNMENT
You may not transfer an account or contractual obligation to another person without our consent where that transfer would materially affect our rights or obligations.
We may transfer rights or obligations to another entity where permitted by law, provided that the transfer does not reduce a consumer’s contractual or statutory rights.
Where legally required, customers will be notified of a transfer.
SECTION 22 - GOVERNING LAW
These Terms of Service and any separate agreements through which we provide the Services are governed by the laws of the Federal Republic of Germany.
If you are a consumer, this choice of law does not deprive you of any mandatory protections granted by the laws of your country of residence.
The applicable statutory rules concerning jurisdiction remain unaffected.
SECTION 23 - HEADINGS
The headings in these Terms are included for convenience and do not limit or otherwise affect their interpretation.
SECTION 24 - CHANGES TO THESE TERMS
You can review the current version of these Terms on this page.
We may update these Terms where reasonably necessary, including because of legal, regulatory, security, technical or operational changes.
Material changes will be communicated as required by applicable law. Such changes will take effect on the date stated in the relevant notice.
Changes will not retroactively alter an accepted order or reduce rights that arose before the change unless permitted by law and expressly agreed.
Continued use of the general Services after updated Terms take effect may constitute acceptance where permitted by law. Where express consent is legally required, we will request it.
